We await a number of key decisions in 2016 which may change the scope of employment law issues. Amongst these decisions are the Court of Appeal decisions on whether or not the uplift of 10% applies to injury to feelings awards (Vento guidelines) for discrimination claims. We currently have two EAT decisions in favour and one against so await a decision from a higher court to resolve this point.
Other decisions include another challenge by Unison to the Employment Tribunal fees which is due to be heard this year following the appeal to the Supreme Court. Of course separately the outcome of the two reviews into employment tribunal fees are also expected which may or may not lead to changes in the current fee system.
There are also two big equal pay claims which will no doubt be in the media eye in 2016. These involving the two supermarket chains – Asda and Sainsburys. It is also expected that a consultation will take place concerning the rights for grandparents to take leave. As always watch this space for the latest news and developments.
