Sarah King Employment Solicitor

pre-claim conciliationJust a reminder that ACAS pre-claim conciliation is now mandatory from today. Claimants must now contact ACAS using the prescribed methods before they bring a claim to the employment tribunal if their claim involves unfair dismissal, discrimination and other common claims set out in the new legislation.

If Claimants don’t confirm that they have an excluded type of claim (which is limited) or provide the ACAS certificate number then the employment tribunal will reject the claim. The time limits will still apply to rejected forms but those that use pre-conciliation will see their time limits frozen or even extended.

For more information check out my more detailed posts on the new rules under Employment Tribunal Rules.

(Our news section brings you the latest news on published judgments and cases which are all in the public domain. We only comment on these published cases and not cases of our actual clients. Publication of the case or comments is a public service designed to make the courts and tribunals more accessible and ensures justice is seen to be done. This is why court and tribunal judgments are published publicly.)
