reasons not toWhen analysing the reasons why Claimant’s decide not to proceed with their claim following ACAS EC there has been much speculation that this is because of the introduction of fees which are preventing access to justice.

ACAS has carried out their own research into the reasons people provide as to their rationale as to why they have decided not to continue. You can read the whole report here but in summary only 20% gave the rationale of tribunal fees as the reason for their decision.

Other reasons given include a perception that they would not win or that it would be a waste of their time which in fact equated to 27 % of the respondents to the survey. The stress of the process also featured as a rationale in the decision not to proceed for 17% of claimants.
