It has been reported that Unite are unlikely to appeal the decision of the EAT in the Bear Scotland v Fulton holiday pay case. The case meant that whilst overtime should be included in holiday pay claims there was a limit as to how far back a Claimant could look to bring a claim. The case is however currently subject to Government review after a task force was set up to review the implications of the decision. The unions were not invited to take part in this taskforce which they have criticised.
Whilst Unite may not be appealing it is likely that at some point the decision will be challenged given its implications for business.
